1. Purpose of the contract

These general terms and conditions of sale aim to set the contractual terms between SRL TONIC, whose registered office is located at rue de Bruxelles 10/5, 4340 Awans, Belgium, registered with the BCE under the company number BE0687.761.177 (hereinafter referred to as "the company") and the Customer.

The purchase of a product through the website www.boutiquetonic.com (hereinafter referred to as "the site") implies the unconditional acceptance of these terms and conditions by the buyer.
The Company reserves the right to modify these terms and conditions at any time. In this case, the applicable terms will be those in effect at the date of the customer's order.

These terms are exclusively applicable when purchasing through the site www.boutiquetonic.com.

2. Right of withdrawal for consumers

The consumer (any natural person who acquires or uses for purposes excluding any professional character products placed on the market) has the right to withdraw from this contract without giving any reason within fourteen days.
The withdrawal period expires 14 days after the day you, or a third party other than the carrier and designated by you, takes physical possession of the product or the last product ordered.
To exercise the right of withdrawal, you must notify your decision to withdraw from this contract via email at info@boutiquetonic.com.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

In case of withdrawal, we will refund all payments received from you without undue delay, except for the return shipping costs, and in any case, within fourteen days from the day we are informed of your decision to withdraw from this contract.
We will proceed with the refund using the same payment method you used for the initial transaction, unless you expressly agree to a different method; in any case, this refund will not incur any costs for you.

If you have received goods under the contract, you must return or deliver the goods to us without undue delay and, in any case, within 14 days after you communicated your decision to withdraw from this contract.

This deadline is deemed to be met if you send the goods back before the expiration of the fourteen-day period.
The article must be returned in its original packaging with the label still attached and must not have been worn except for fitting.

You will bear the direct return shipping costs, estimated to be a maximum of approximately 10 EUR.
Shipping costs will only be refunded if the withdrawal occurs before shipping.

3. Product characteristics

The items offered are those listed in the catalog published on the site.
Each product is accompanied by a description provided by the Company.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly in terms of colors.

The products presented on the site are offered subject to availability.

4. Geographical area

Online sales of the products presented on the site are reserved for buyers residing in Belgium, France, Germany, the Netherlands, and the Grand Duchy of Luxembourg.

5. Prices

The prices displayed on the site are in EUR and include VAT applicable on the day of the order.
Any change in the tax rate may be reflected in the price of the items.
The Company reserves the right to modify its prices at any time, but the price listed in the catalog on the day of the order will be the only one applicable to the Customer.

6. Orders

The Customer wishing to purchase a product on the site must:

• Choose the items and add them to the cart;

• Validate the cart content;

• Fill in the identification form on the site or register with the identification details required;

• Choose the delivery method;

• Choose the payment method;

• Accept these general terms and conditions of sale;

• Validate the payment.
  The Customer may at any time review the order details and the total price during the ordering process and correct any errors before confirming it.
  The Customer will receive an order confirmation email.
  The Company reserves ownership of the items until full payment is made, meaning once the order price is fully received by the Company.
  The Company reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment of a previous order.
  The order confirmation entails acceptance of these terms and conditions, acknowledgment of having read them, and waiver of any conditions of sale or other conditions.

7. Payment methods

Accepted payment methods include Bancontact, credit cards (Visa, MasterCard), PayPal, and bank transfers.
Regarding bank transfers: the order is placed on hold until the payment is received, and shipment will only occur on the day the Company’s bank account is credited.
If payment is not received within 14 days, the order will be considered null and void.

8. Shipping and delivery times

Any order placed on the site before 1 p.m. will be prepared and shipped the following day (except on Saturdays, when orders will be shipped on Monday), subject to payment validation.
The Company is committed to delivering orders placed by the Customer within the agreed timeframes.
If the items have not been delivered within 7 days from the scheduled delivery date, and if this delay is not due to force majeure, the Customer may cancel the sale by sending a registered letter to the address mentioned in article 1.
The amounts paid by the Customer will then be fully refunded.
The shipping method is detailed in the product information and confirmation email.
For Belgium, the delivery fee is 6.00 EUR per order.
For France, Germany, the Netherlands, and Luxembourg, the delivery fee is 13.00 EUR per order.
Upon receipt of the products, the Customer or recipient must check the condition of the delivered goods.
If any product is missing or damaged, the Customer or recipient must file any complaints with the carrier at the time of delivery, or the claim will be barred.

9. Privacy

All information sent through the site is entirely confidential.
The Company commits not to share it with third parties.

10. Intellectual property

All elements of the site, including the underlying technology, are the intellectual and exclusive property of the seller.
Anyone wishing to use these elements must first obtain authorization from the Company.
Likewise, any hyperlink referring to the site is prohibited unless written permission is granted by the Company.

11. Liability

The Company, in the process of online sale, is only bound by an obligation of means. Its liability cannot be engaged for any damages resulting from the use of the internet network, such as data loss, intrusion, viruses, service interruptions, or other involuntary issues.
For any order shipped outside of Belgium, the Customer is considered the importer of the ordered products and must comply with the legal obligations in this regard.
It is the Customer's responsibility to verify whether it is possible to import the ordered products with the authorities of their country.
The details provided by the Customer during the order process are binding.
The Company is not liable for errors made by the Customer in the address details (e.g., delivery and billing addresses), nor for delays or failure to deliver the products resulting from such errors.

12. Disputes and applicable law

Disputes arising from or in connection with this contract will be subject to Belgian law.
